Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the recruitment services provided by EasyTalent (“EasyTalent”, “we”, “us”, or “our”). By purchasing an Engagement Period, you (“Client”, “you”, or “your”) agree to be bound by these Terms.

2. Service Description

EasyTalent provides recruitment services on a per-Position, per-month basis. Each monthly unit of service is defined as an Engagement Period.

An Engagement Period refers to a 30-day billing period purchased by the Client during which EasyTalent undertakes recruitment activities in respect of a specified Position.

A Position refers to the specific job vacancy identified by the Client for which recruitment services are provided during an Engagement Period.

Each Engagement Period applies to one Position unless otherwise agreed in writing.

Services include recruiter time allocated to sourcing, screening, and managing the recruitment process for the active Position during the Engagement Period. The level of activity may vary depending on Position complexity, market conditions, and Client responsiveness. Recruiter time is allocated across EasyTalent’s client engagements and is not exclusive to any single Client.

3. Pricing

Pricing is charged per Engagement Period during recruitment.

Pricing is fixed and is not calculated based on candidate salary or placement outcome. EasyTalent does not charge commissions or success fees.

Billing commences when an Engagement Period is activated and stops when it is paused or cancelled in accordance with these Terms.

Pricing may be subject to promotional discounts as outlined in Section 18.

4. Price Changes

EasyTalent reserves the right to change pricing or alter service inclusions. Clients will be provided with at least 60 days’ notice of any pricing changes.

5. Payments

Payments are made via credit or debit card through our website.

Charges renew monthly from the date of the initial payment unless the Engagement Period is paused or cancelled prior to renewal.

Clients will be notified by email at least 7 days before renewal.

6. Candidate Ownership

The Client retains ongoing rights to contact and hire candidates introduced by EasyTalent, with no time limitation and no placement or success fees payable.

The Client is responsible for complying with all applicable privacy, employment, and data protection laws when contacting or engaging candidates.

7. Delivery of Service

EasyTalent will provide recruitment services for each active Engagement Period using reasonable endeavours and in a professional manner.

Purchase of an Engagement Period does not guarantee a hire. EasyTalent does not provide replacement guarantees, rebate arrangements, or outcome-based warranties in relation to any candidate engagement.

Candidate screening conducted by EasyTalent will be undertaken via video call. In-person interviews are not included.

Any reference to a 7-day shortlist is indicative only and not a guaranteed deliverable. Timeframes depend on Position complexity and market conditions.

EasyTalent operates exclusively within Australia.

8. LinkedIn Advertising

Advertising activity is at EasyTalent’s discretion. Each Position includes up to A$500 in LinkedIn advertising, applied once per Position. This allocation does not reset or renew if the Engagement Period continues beyond the initial 30 days.

Unused advertising allocations are forfeited if an Engagement Period is paused or cancelled prior to use.

Any additional advertising costs will be at the Client’s expense unless otherwise agreed in writing.

9. Pause and Cancellation

Clients may pause or cancel an Engagement Period at any time. No notice period is required.

A pause takes effect immediately. Where an Engagement Period is paused, recruitment activity ceases from the pause date and any unused time remaining in the current Engagement Period may be banked in accordance with Section 11. No further billing will occur while the Engagement Period is paused.

A cancellation takes effect at the end of the current Engagement Period. Recruitment services will continue until the end date of that Engagement Period. No refunds are provided for partial billing periods.

10. Banked Time

Where an Engagement Period is paused, any unused time remaining in the current Engagement Period may be banked for future use by the Client. Banked time is not refundable, has no cash value, and may only be applied to future recruitment services provided by EasyTalent.

Banked time may be applied to a future Engagement Period engaged by the same Client. Banked time must be used within six (6) months of the pause date. Any unused banked time expires after this period. Banked time is not transferable to another Client.

11. EasyTalent's Rights

EasyTalent reserves the right to refuse service to any Client and to end an Engagement Period at the conclusion of the current Engagement Period.

12. Refund Policy

A 7-day trial period applies from the date an Engagement Period is activated. If the Client cancels within 7 days of activation, they may request a refund of up to 75% of the amount paid for that Engagement Period. Refunds are issued at EasyTalent’s discretion.

After the 7-day period, all amounts paid are non-refundable.

13. Client Responsibilities

Clients are responsible for providing accurate Position descriptions, role requirements, and relevant information necessary for recruitment. Clients must review candidate submissions and provide feedback in a timely manner.

The Client is solely responsible for making all hiring decisions and for conducting any reference checks, background checks, employment checks, or other due diligence it considers necessary prior to employment.

EasyTalent does not warrant or guarantee the honesty, suitability, performance, or conduct of any candidate.

14. Confidentiality

EasyTalent will keep all Client information and discussions confidential, except where disclosure is required by law.

15. Limitation of Liability

To the extent permitted by law, EasyTalent will not be liable for any indirect, consequential, or incidental loss arising from the use of its services. Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any disputes arising under these Terms.

17. Amendments

EasyTalent may amend these Terms from time to time. Changes take effect upon publication on our website, except where otherwise stated (including pricing changes under Section 4).

18. Promotions and Discounts

EasyTalent may offer discounts from time to time, including discounts for multiple Engagement Periods. Any discount for multiple Engagement Periods applies only when three or more Engagement Periods are purchased in a single transaction. Discounts do not apply retroactively and do not apply to Engagement Periods added, activated, or purchased at a later date.
